On 26 March 2020 we issued a statement on the interventions we have taken in light of the outbreak of Covid-19. Several developments have taken place since then:
- the first positive cases were reported in Botswana on 30 March 2020;
- the President declared a State of Public Emergency with effect from midnight on 2 April 2020;
- regulations in terms of the Emergency Powers Act [Cap. 22:04] were passed on 2 April 2020. In terms thereof, legal practitioners have been classified as essential service providers; and
- on 9 April 2020, the National Assembly voted for the State of Public Emergency to continue for a period of 6 months.
To ensure the health and safety of our staff and clients, we have decided to provide our services remotely only, save for urgent matters which may necessitate our staff to work from the office. In addition to the usual services we provide, we have swiftly strengthened our knowledge and expertise to assist our clients to deal with the peculiar challenges emanating from this period. These specific issues include:
- employment issues, for employers classified as essential services and those who have unfortunately had to close their business operations;
- trading issues, including pricing and competition concerns during this period;
- contractual force majeure claims and defences;
- compliance and governance issues to assist boards of directors navigate this period appropriately;
- restructuring of facilities with financial institutions; and
- insolvency and restructuring issues.
