Kelebileone Malefo has acted for both local and international clients in litigation proceedings across various sectors, with a particular focus on construction, mining, energy, and banking. He has a broad range of experience in commercial litigation, arbitration, resolution of labour disputes, intellectual property as well as general advisory and regulatory work. He regularly advises financial institutions on third-party insurance claims, corporate recoveries, insolvencies, and restructuring. He also advices on resolution of procurement disputes.

Kelebileone possesses a unique skill set that has produced immaculate results across different disciplines. He;

  • successfully acted for our client Landmark Projects (Proprietary) Limited against the PPADB and 9 other contractors in a dispute where a tender for construction of a public road was unfairly adjudicated and awarded to a competitor. The procuring entity having deviated from the tender conditions, the matter was resolved fully and finally by the Court of Appeal in favour of our client who was found to be the compliant bidder.
  • acted as counsel to First National Bank Botswana Limited (“FNBB”) in liquidation proceedings of a company in the business of hospitality and tourism and a subsequent action against sureties and co-principal debtors. The liquidation proceedings were completed and the action against sureties is currently pending before the Court of Appeal.
  • acted for FNBB in the judicial management and subsequent liquidation of an engineering and construction company.
  • successfully represented Bank Gaborone Limited against BURS in a matter involving tax dispute, in particular assessment of VAT under the VAT Act. The Court of Appeal ruled in favour of our client and ordered BURS to pay a tax refund in the sum of BWP3,890,964.49.
  • is representing the liquidator of BCL Limited (in liquidation) in respect of a claim arising out of a contract for importation of supply of Nickle concluded between BCL and Riozim Limited, as well as related proceedings for substitution and recognition of the current liquidator, following the demise of the former BCL liquidator. The litigation is currently pending before the Courts in the Republic of Zimbabwe.
  • represented clients in the retail and mining industry in employment disputes ranging from retrenchments and termination of employment contracts.
  • represented the developer in arbitration proceedings of disputes emanating from the contract for the development of a mixed use development in the Gaborone CBD.
  • represents clients in the energy sector in arbitration of disputes emanating from commercial agreements.
