Yemulani Alfred’s practice areas are technology, cyber and data protection, dispute resolution, commercial litigation and regulatory and advisory. She has advised and assisted in various litigation proceedings with a particular focus on employment and labour law, debt collection, property law, construction law and public procurement law amongst others. She has also drafted and reviewed various agreements and provided regulatory advice across several areas of the law such as data protection law, employment law and public procurement law.

Yemulani possesses a unique skill set that has produced immaculate results across different disciplines. She has:

  • successfully acted for our client Landmark Projects (Proprietary) Limited against the PPADB and 9 other contractors in a dispute where a tender for construction of a public road was unfairly adjudicated and awarded to a competitor. The procuring entity having deviated from the tender conditions, the matter was resolved fully and finally by the Court of Appeal in favour of our client who was found to be the compliant bidder.
  • successfully acted for Landmark Projects (Proprietary) Limited in a contractual claim for damages instituted by TKM Engineering (Proprietary) Limited arising from an alleged breach of a sub-contract for development of public infrastructure;
  • provided advice to Jarcon Opencast Mining on termination of employment contracts;
  • successfully acted for ND Estates (Proprietary) Limited in various eviction and arrear rental collection matters;
  • successfully acted for First National Bank of Botswana Limited in various debt collection matters with claims ranging in the millions as well as repossession matters;
  • successfully acted for Access Bank Botswana Limited in various debt collection matters with claims ranging in the millions;
  • successfully acted for Zhong Gan Engineering and Construction (Proprietary) Limited and Pota Pan (Proprietary) Limited against the Director of Public Prosecutions in relation to the Proceeds and Instruments of Crime Act; and
  • provided advice on data protection compliance to University of Stellenbosch Business School Executive Development - Botswana (Proprietary) Limited which advice included amongst others, facilitating training on the Data Protection Act, drafting standard contract clauses to provide adequate safeguards with respect to the protection of the rights of data subjects and reviewing privacy notices.
